A federal judge has dismissed the Trump administration’s indictment of New York Attorney General Letitia James on alleged mortgage fraud, stating the prosecutor in the case was unlawfully appointed.
The Hill reports US District Judge Cameron Currie, a Clinton administration appointee, ruled that Lindsey Halligan, the US attorney named by Trump on Sept. 22 to prosecute James, was ineligible to assume the position because the 120-day period for interim appointments expired during the tenure of Erik Siebert, who was named interim US attorney for the Eastern District of Virginia on Jan. 21. That period lapsed on May 21, but the district judges at the time unanimously voted to retain him until he received Senate confirmation. However, Siebert was not confirmed and he resigned under pressure from Trump after complaining there was insufficient evidence to prosecute James.
The judge ruled the authority to appoint a replacement for Siebert now belonged to the district’s federal judges and not Attorney General Pam Bondi. The indictment of James was dismissed without prejudice, meaning the Department of Justice could attempt to resurrect the charges with another prosecutor.
The case against James stemmed from a criminal referral made by Bill Pulte, the director of the Federal Housing Finance Agency, who alleged James falsely claimed a property she acquired in Virginia was her primary residence. The Department of Justice brought a two-count indictment against her, charging her with bank fraud and making false statements to a financial institution. James denied the charges and said the case stemmed from political retribution by Trump against her prosecution of him and The Trump Organization for alleged valuation fraud of their properties.
Another indictment brought by Halligan involving former FBI Director James Comey was also dismissed because Halligan was deemed ineligible to prosecute the case.

He was convicted of fraud mortgage fraud actually by thst very same DA he was inflating and deflating the values of his property to get bank loans and deflating to escape taxes. These were charges he was found guilty of in New York so you live under a rock? Or just Magawonderland?
Try doing what James and Comey did and see how long you could avoid prosecution. Better yet, try doing what Hunter and the Biden family did.

Seems like when he knew the right people, a certain dude with ‘files’ after his name all of the time, got a super light prison sentence in Florida. Then, after he was assassinated in jail waiting for sentencing, his girlfriend/accomplice was caught, but THEN, she was recently visited by the sitting POTUS’ personal lawyer and got a MUCh nicer prison location…because SHE knows the current president (and basically went around the court system at that point). If you know the right people (the president, for instance), you can sell children to rich jerks if you want. We better not try this or we would would be immoral reprobates who deserved to die a painful death.

This is a dismissal based on the authority of the prosecutor to act in the matter – a procedural technicality – not a hands-down win for Ms. James. The court made no decision on the merits of the case against her. Not sure why she is so joyous in the photo. The dismissal was without prejudice, so the government can go back and try again. I’m not dancing in the street for Ms. James. Stay tuned. If the case is heard on its merits, it should be decided based on the facts presented. Period.
We have no idea where or why that photo was taken. It is totally out of context (which is not surprising given the place we are seeing it).
Having said that, your assessment is otherwise spot-on. She may be charged again soon, and then the actual merits or lack thereof will be known.
In both her case and the Comey situation, the regime has potentially spoiled the jury pool for either of them (or others, like Swalwell) to even get a fair trial, since these mopes just cannot keep their traps shut for three minutes without self-aggrandizing just getting dressed in the morning.
Maybe all of them are guilty, maybe none of them…but we won’t know if the people working for this administration continue being so incompetent as to even bring clean charges with clear evidence and not tainting the jury for it.
So it doesn’t matter if a crime was committed. Just throw the baby out with the bath water. She did exactly what she accused Trump of doing. AND, if it were you or I, HOT WATER!
