New York Attorney General Letitia James is seeking to have her mortgage fraud indictment dismissed, citing the legality of newly appointed Lindsey Halligan as the prosecutor for the case.
CNN reports James’ legal time submitted a two-page court filing that “challenges the unlawful appointment of the United States Attorney for the Eastern District of Virginia, Lindsey Halligan.” Halligan was appointed by President Trump after Interim US Attorney Erik Siebert resigned after refusing to bring charges against James after citing insufficient evidence to proceed with the case. Halligan was one of Trump’s personal lawyers and has no prosecuting experience.
James was indicted on two felony charges of bank fraud and making false statements to a financial institution, based on a criminal referral made by Federal Housing Finance Agency Director Bill Pulte. She is scheduled to appear in court this morning in Norfolk, Virginia, where she is expected to enter a not guilty plea.
James’ attorneys are also asking the federal judge overseeing her criminal case to prohibit federal prosecutors from discussing the case with reporters. This follows reports that Halligan communicated with a journalist over the Signal messaging platform about the case two days prior to achieving a grand jury indictment. talking with the media about it to ensure she has a fair trial.
“These extrajudicial statements and prejudicial disclosures by any prosecutor, let alone one purporting to be the US Attorney, run afoul of and violate the Federal Rules of Criminal Procedure, the Code of Federal Regulations, this Court’s Local Rules, various rules of ethical and professional responsibility, and DOJ’s Justice Manual,” James’ attorneys wrote in court papers. “In order to ensure a fair trial and impartial proceedings for Attorney General James, we respectfully seek the Court’s intervention to prevent any further disclosures by government attorneys and agents of investigative and case materials, and statements to the media and public, concerning this case and any parties or witnesses.”
James’ attorneys are also seeking a list of the media outlet contacted by the prosecutors.
“As the prosecutor who is ‘handling the case’ against Attorney General James and purporting to be the U.S. Attorney, Ms. Halligan is supposed to be the standard-bearer of the professional responsibility rules rather than the District’s violator-in-chief,” James’ lawyers added in their filing.

Interesting that she won a case in the court system against our criminal president. Yes it was overturned but she did win just not the money side. And the other person is correct that no one is above the law!!!! Letitia Will go to court and the court not Fox News with decide if she is guilty or not. Baby Trump is vindictive and to say he’s not is not correct.
She either lied on her mortgage application or she did not. Whether or not Trump is a bad guy or a baby or vindictive is irrelevant. If she did lie, she will likely be convicted. If she did not, she will likely not. Assuming an unrelated legal technicality does not intervene, as it often does, such as the legality of the prosecutor. If that happens, she will likely be charged by a different prosecutor.
If she broke the law by lying on her application, she needs to be like the general public and suffer the punishment. Or anyone before her that committed fraud on their application
should be let go, heck why don’t we all just commit fraud like her! If there are no consequences.
Ms. James is getting what she tried to do to the President. Her accusations were very politically motivated. She was part of the Democrat cabal against Republicans. However, I don’t like any persons associated with this lawsuit to discuss any private evidence or information on its merits or lack thereof in the public sphere. That is reserved for the court room. All of us of course are armchair quarterbacks with what publicly disclosed information is available. I just hope that justice is rendered in a fair and impartial manner in the court room whatever that may be. When the verdict is reached I think that its results will problem linger in the political realm and could morph into more accusations in search of political retribution. I wonder who will be next on the chopping block? Regardless Ms. James appears to have wanted her cake and eat it too thinking she was above the law. She opened Pandora’s box and is suffering from its contents. What a can of worms! Don’t ya just love NY politics!
It is extremely interesting that the Demogods all proclaim that “NO ONE IS ABOVE THE LAW” ironically, except them.
Mortgage Fraud is a very serious crime. The Dodd Frank Act was voted into law by congress to protect lenders and banks from dishonest borrowers and provide a remedy. If Ms James is innocent, she should welcome going to court and proving herself innocent. The paperwork on her loan application is pretty black and white. She either lied and misrepresented or she did not.
I She committed mortgage fraud… what more do you need to know I want justice for her, I believe she is guilty , let the law take it’s course! If I did it I would be in jail, why should she walk free! enough said!

The questions are pretty straight forward on all these applications. Is this to be your primary residence or secondary residence, or will this be a rental property? She knew the answers and if you answer falsely then you have committed fraud. What is your relationship with the co-applicant? Father or husband? Her father is clearly not her husband so if she knew the correct answer but instead claimed her relationship with the co-applicant was husband and wife then she answered falsely and committed fraud. It is interesting that all her “oopsie” “mistakes” just happened to put her applications in a more favorable light to the lenders and also more favorable loan terms.
