A New York state appellate judge ruled that New York City Mayor Zohran Mamdani can continue with the rollout of pied-à-terre tax while it continues to face a legal challenge.
On Monday, Staten Island Judge Wayne Ozzi on Monday issued a temporary restraining order blocking the introduction of the new tax after a lawsuit was filed by homeowners who alleged the rollout was being improperly handled.
CNBC reports Mamdani’s administration filed a motion to seek an appeal, while triggered an automatic stay. The city then sought a confirmation from the appeals court on the auto-pause, claiming that Ozzi’s ruling “threatens to derail the City’s time-sensitive implementation of a new surcharge.”
The tax is designed to target the owners of luxury second homes – condominiums and co-ops valued at a minimum of $1 million and one- to three-family homes valued above $5 million.
President Trump came out against the tax, writing on Truth Social, “I am looking to see if the Federal Government has any legal right to avert this disaster, before it is too late.” However, Attorney General Todd Blanche declined to say if the Department of Justice was reviewing legal options to halt the tax from taking effect.
