California is poised to make history for offering state-financed mortgage assistance to illegal immigrants.

According to combined media reports, the proposed legislation AB 1840 would require the California Dream for All Shared Appreciation Loans program to overlook the immigration status of applicants for loans that are up to 20% of the home’s purchase price, with assistance provided up to $150,000 per person. The only interest paid on this loan is 15% or 20% of the home’s increase in value upon selling the property, depending on their income level. The program is run by the California Housing Finance Agency and receives state funding.

The bill has already passed the state’s Assembly and the Senate is expected to vote on the measure this week. Gov. Gavin Newsom has not publicly stated if he would sign the bill into law.

The bill’s author, State Rep. Joaquin Arambula (D-Fresno), has sought to downplay the immigrant status nature of his bill by highlighting that applicants must meet Fannie Mae requirements, including having a taxpayer identification number or a Social Security number to prove they are taxpayers.

“We simply wanted to be as inclusive as possible within our policies so that all who are paying taxes here in our state were able to qualify,” Arambula said in an interview with Politico. “Without the intentional law that we are introducing, we felt that there were complexities and questions that many in the immigrant community would have.”

Competition for the program is tight – 18,000 individuals applied for the $255 million program this year through a lottery, resulting in 1,700 applicants winning up to $150,000 each towards down payment and closing costs.
