The Fourth Circuit upheld the U.S. Army Corps of Engineers’ Clean Water Act permit for the Cainhoy Plantation development on October 23, 2026. The proposed development encompasses portions of a 9,076-acre property near Charleston, South Carolina.

According to the court’s published opinion, the development plan covers approximately 3,906 acres and includes housing, commercial space, schools and medical facilities. Wetlands impacts were reduced from an earlier proposed 1,820 acres to approximately 181.5 acres.

Appeals court upholds environmental review

Environmental organizations challenged the Corps’ analysis of practicable alternatives. The appeals court affirmed the permit, finding that the agency adequately evaluated alternatives and explained its decision.

The Justice Department welcomed the ruling as a step toward meeting regional housing demand.

The decision upholds a federal wetlands permit; it does not establish that all other development approvals have been obtained. A final housing-unit count and construction timetable have not been verified.
