In brief: Homebuyers who purchased an MLS-listed property during certain qualifying periods may have only days left to seek compensation from a nationwide real estate commission settlement. The October 27, 2026 claim deadline is approaching for a settlement fund totaling $120,334,500.

The deadline is confirmed by the official Homebuyer Antitrust Litigation settlement administrator. Claims must be submitted online or postmarked by October 27. The court has scheduled a final approval hearing for November 2; the settlement has not yet received final approval.

Who may qualify for a payment?

The settlement concerns Tuccori et al. v. At World Properties LLC et al., a class action in the U.S. District Court for the Northern District of Illinois. In general, consumers may qualify if they purchased a home listed on a multiple listing service in the United States and a commission was paid to a brokerage in connection with the transaction during the applicable class period.

But eligibility is not automatic. The covered dates differ by state and by defendant. Certain people covered by separate home-seller commission settlements are excluded. Buyers should review the official settlement website and its notices rather than assume every purchase qualifies.

The case alleges that the National Association of Realtors and participating brokerage companies engaged in anticompetitive conduct that inflated real estate commissions and harmed homebuyers through higher prices and reduced services. The defendants deny wrongdoing. The court has not ruled that the allegations are true.

How to file before October 27

Eligible consumers can start a claim through HomebuyerSettlement.com, the court-appointed administrator’s website. The administrator also accepts paper claims sent to Homebuyer Antitrust Litigation Settlement Administrator, P.O. Box 4258, Portland, OR 97208-4258.

Claimants should be prepared to identify the qualifying property and transaction, including the purchase date, price and commissions, and to supply supporting documentation as required by the claim form. Closing disclosures, settlement statements or other purchase records may help substantiate eligibility.

October 27 is a submission or postmark deadline, not a payment date. Homebuyers mailing a claim should allow time for postal processing and ensure it is postmarked on time.

How much will claimants receive?

No individual payment amount has been established. The settlement fund totals $120,334,500, but court-approved legal fees, administration expenses and other costs may reduce the amount available for distribution. The eventual payout depends on the number of valid claims and other factors under the settlement terms.

Payments would follow final approval and resolution of any appeals. Filing a timely claim does not guarantee a particular payment.

How this differs from earlier NAR coverage

WRE News reported in April that the National Association of Realtors had agreed to contribute $52.25 million to resolve homebuyer commission claims. The present $120.3 million figure represents the combined settlement fund involving NAR and multiple brokerages, not a new $120 million payment by NAR alone.

For buyers who may qualify, the immediate issue is the deadline. The official administrator provides the full eligibility criteria, notices and claim process. Consumers should use that site rather than unrelated third-party claims services.
