Judge Rejects Preliminary Injunction Request by Move Against CoStar

A district court judge has issued a ruling in favor of the commercial real estate data provider CoStar Group (NASDAQ:CSGP), which is being sued by Move Inc., the News Corp (NASDAQ:NWSA) subsidiary that operates Realtor.com, for hiring a Realtor.com employee who allegedly brought along his former employer’s trade secrets.

Judge George H. Wu of the U.S. District Court for the Central District of California denied Move’s motion for a preliminary injunction and limited expedited discovery in the lawsuit against CoStar. The judge wrote that the court was “not persuaded that Move has demonstrated, with evidence, likely, and imminent, irreparable harm, even if it can demonstrate past misappropriation at least on Kaminsky’s part.”

Wu added that Move “has not made the ‘clear showing’ that it should be awarded the ‘extraordinary’ and ‘drastic’ remedy of a preliminary injunction.”

Move’s lawsuit accused James Kaminsky, a former Realtor.com employee who took a job at CoStar, with providing his new employer with stolen documents related to its business strategy, industry contacts and confidential data. The lawsuit added that CoStar is using this information to bolder Homes.com, a rival to Realtor.com which Move insisted “has not, until recently, been a significant player in the industry.”
