Landlords Sue to Stop Mamdani’s Rent Freeze

A group of New York City landlords has filed a lawsuit to overturn the recently enacted rent freeze in stabilized apartments.

The Real Deal reports six landlords are asking the New York Supreme Court to void the freeze approved by the Rent Guidelines Board and resubmit the issue the board for a rent increase. The lawsuit argued the board’s vote for a rent freeze was a “sham” because the outcome was predetermined by Mayor Zohran Mamdani, who campaigned on forcing a freeze and appointed board members allied to his goal.

To back their complaint, the landlords cited the resignation of former board member Christina Smyth, who represented owners on the nine-member board and who stepped down on the morning of the vote because she felt it was only “theater.” The landlords also sought to justify their push for a rent increase by citing the board’s data on how landlord operating costs increased 5.3% in the past year.

“[T]he Mayor went to extraordinary lengths to pack the Board with loyalists and then spent millions in City funds to fill the Board’s hearings with tenant advocates,” said the landlords in their complaint. “That Mayor Mamdani preordained this outcome and then took affirmative steps to stack the deck is now undeniable.”

Representatives for the Rent Guidelines Board and Mamdani’s office did not publicly comment on the lawsuit.

  1. It’s should be obvious what Mamdani is doing. He’s trying to steal rental units by driving private owners out of business.

  2. Seems if he is truly interested to keep affordable rents he would decrease property taxes and allow owners to pass on savings.

    • Exactly. Renters support this and massive giveaway budgets because they don’t know any better. They never realize that massive budgets and property taxes only go toward rent increases. When values surge, so do assessed values that are subject to taxation. So higher taxes affect EVERYONE, renters and owners. When values surged in Austin, Texas the rents had to raise and none of it was to profitability for the landlord. It all went to taxes. Same with insurance rates that have skyrocketed. Landlords would prefer to keep good tenants in place for long periods of time. Raising rent like $400/month and have it all go to taxes doesn’t benefit anyone but the city.

  4. It’s much deeper than just rent control. The courts have made it impossible for landlords to evict bad tenants. All the legal rights seem to be for tenants. Tenant advocates make it almost impossible to make a living. I feel sorry for the young entrepreneur that thinks he can do well by purchasing a rental.

  5. As Realtors. We should be setting off alarms. But I’m not seeing this. I see people entering into this business for the money. They don’t seem to understand what is at risk. Or maybe they just don’t have the time.
    Wake up and vote accordingly or there will no longer be private property ownership. They will tax you out of it or code you to loseor forfeit it. I would never would have thought I would see this in my lifetime. Never. But it’s here and not nearly enough people recognize it for what it truly is.
    In our law abiding household I was always taught that the right to bear arms was imoortant least the government. Our government. Get too powerful. Again. Here we are.
    Pay attention. It’s small incremental things that lead to the fall of a nation. Even one that pretends to look out for its citizens. Especially the down trodden. (Weak and simple minded). Easy prey for them to sway.
