Summary
A declaration reportedly filed October 29 in the Western District of Missouri put balances in identified real estate commission settlement accounts at $711.25 million as of September 30. WRE News has not independently inspected the filing. The reported account balance does not establish when sellers will be paid or the size of individual distributions.
Accounts tied to the nationwide real estate commission antitrust settlements held more than $711 million at the end of September, according to a newly filed declaration in federal court in Missouri. The disclosure offers a clearer picture of money held for the settlements, but it does not establish when eligible home sellers will receive payments.
The declaration was signed October 13, 2026, by Isaac Lim, a senior vice president and senior risk officer at Morgan Stanley Smith Barney, and filed October 29 in the U.S. District Court for the Western District of Missouri, according to reporting by Inman and HousingWire. The underlying balances are as of September 30.
What the accounting reports
The identified Morgan Stanley settlement accounts held $711,251,720.86 as of September 30. During January through September 2026, those accounts reportedly received $17,705,101.82 in interest, while $5,780,467.43 was transferred out.
The filing, as described in the published accounts, does not identify the purposes of the transfers or show that they were distributions to class members. Nor should the account balance be treated as the entire value of all settlements in the litigation.
Millions of claims, no confirmed payment timetable
Settlement administrator JND Legal Administration previously reported processing more than 2.7 million claims. The administrator has also faced judicial scrutiny of its billing, with the court ordering an examination of settlement administration expenses.
The official settlement information website states that payments are to be made after appeals are resolved. That does not provide a confirmed payment date or an estimate of what an individual claimant might receive.
Why it matters
For home sellers who submitted claims, the new accounting provides a snapshot of funds held in designated accounts while important questions about distributions remain unanswered. For the real estate industry, it underscores the long financial and legal aftermath of the commission litigation.
